Hola David, quería preguntarte si sabes si Safe Creative y My Free Copyright sirven de algo en caso de plagio. Cuando hablo de plagio me refiero a un pequeño artículo de un blog que después ha sido publicado en un libro sin citar la fuente. Sabes si hay alguna sentencia aquí en España ganada por un bloguero con sus artículos registrados en Safe Creative?

Es toda una "aplastada de derechos" lo que quieren hacer, pero lo peor vendrá cuando, por cualquier causa que les incomode a quienes les favorece la disposición de esa ley, empiecen a cerrar webs y blogs a discreción.

Ojalá eso no pase, porque eso sería aplastar un derecho más fundamental todavía: la libertad de expresión.

¿Podrían llegar a hacerlo?

De todas formas entiendo que si a estos señores les da la gana de cerrarme mi página web yo podré ir a un tribunal a denunciarlo porque sino esto sería el colmo de los colmos.

Además, como bien dice "José GDF", si se ponen a cerrar cualquier web y blog a discreción porque les incomoden pues apaga y vámonos, porque webs y blogs que les incomoden hay a tutiplén.

Todavía no acabo de entender por qué la industria musical o cinematográfica necesita lanzar sus páginas de distribución (ejem, venta) de contenidos.

En un mundo capitalista en el que la tendencia es el outtasking y e outsourcing deberían aliarse con un especialista en distribución de contenidos y lavarse las manos del engorro que supone dedicarse a un negocio (como la distribución online) que no es el suyo.

En cualquier caso en el caso de portales de pago en el que por suscripción se puede acceder a contenidos novedosos y de calidad yo me suscribiría si el precio es razonable.

Me parece que no hacen esto porque no quieren repartir beneficios con ningún aliado estratégico. Considero que es una situación egoísta.

Esto se llama PREVARICACIÓN. En un estado de derecho los poderes están separados (para evitar abusos). Poco a poco el Poder Judicial está siendo "ninguneado".¿Reaccionarán a este nuevo paso?, ¿será demasiado tarde cuando se den cuenta de que les toman por el pito del sereno?, ¿cómo puede una "abogada" dar clases a un Juez/a?, ¿qué edad tiene esa "abogada"?. Tal vez está persona tuvo la suerte de "estudiar" con la LOGSE (otra gran ley) y "promocionar" por la edad.

En el fondo no es tan mala esta ley. Si la aplican, saltándose la separación de poderes y prevaricando a todo trapo, me estarán legitimando para que yo también me salte las leyes que no me interese cumplir. Ya tarda en empezar la fiesta.

Una pregunta. ¿Si la pagina de enlaces incluye comentarios, descripciones y criticas de las películas a las que enlaza, que son casi todas las que he visto, su cierre no afectaria al derecho a expresión y por tanto el juez que debe comprobar que el cierre no afecte a derechos fundamentales no debería denegar el cierre?

Corregidme si me equivoco pero, tras la aprobación de la ley, las páginas de enlaces únicamente tendrán que mudar su alojamiento fuera de España para burlarla. Como decimos siempre, no se pueden poner puertas al campo.
Una cuestión para David, ¿es inconstitucional la ley? ¿Se podrá recurrir ante este tribunal?

A muchos lobbi ya les va bien esta panda de "golpistas culturales", sobretdo americanos y franceses por eso todavía andan fastidiando, pero como ya he dicho hay MILES DE FORMAS DE COMPARTIR CONTENDIOS dentro y fuera de Internet y si no descargo no voy a comprar mas :), la tenologia supera ampliamente el nivel de inteligencia de cualquier dictador de tres al cuarto.
Es de primero ce carrera que cualquier empresa que insulte a sus clientes tiene los dias contados, que avasallar a los clientes los convierte en futuros clientes de la competencia, si no la hay, la habrá y que el camino de la prohibición y la censura lleva en contrapartida la rebelión y la transgresión, ellos mismos se estan cavando su propia fosa.

Con esta gente no se pueden plantear razones ni alternativs legales o lógica, no saben de qué va internet. De todas formas se han topado con la ira de 4chan.org y creo que van a salir trasquilados (del todo)

hola david, yo esto estudiando administracion y direccion de empresas y me especializare en marketing, en una asignatura que se llama estrategias de marketing por internet abri un foro de debate acerca del tema de internet y las descargas y como la industria se beneficiaria de internet. Yo propuse que una buena solucion es que las propias discograficas creen sus paginas p2p y vivan de los ingresos publicitarios que obtengan de dichas webs, no hacen eso las teles?? y las radios?? lo que propongo es que de este modo las discograficas puedan competir en igualdad de condiciones con las p2p si lesionar los intereses de los usuarios tu que opinas??

Siempre pueden acudir a la corte suprema de justicia (no se como se llame en España) alegando inconsistencia con el derecho y separacion de atribuciones en la futura ley. Deberian ir pensando esa opción.

Las paginas de enlaces que ya han sido declaradas legales por un juez no deberían de ser inmunes a esos cierres administrativos?

No es ilegal imponer una condena a alguien que ya ha sido absuelto?

Si esto es así ese puñado de paginas que ya han ganado los juicios podrian acaparar todas las búsquedas.

Esto y otras muchas cosas llevan a la conclusión de que habría que cambiar todo, destruir para crear.

Estos políticuchos se nutren (y muy bien) del dinero de todos para favorecer una y otra vez a sus amigos.

En organizaciones más pequeñas no pasaría esto jamas, por que a las primeras de cambio se les desterraría (en el mejor de lso casos).

¿Qué nos pasa con el sistema actual? (podrido hasta las trancas): pues que tenemos que aguantar a una meacolonias como sinde, una payasa como Pajín, un megacorrupto como Bono, un BOBO como ZP.......

Muy bueno, David, tu post. Lo más ridículo que veo de esta bazofia de ley, además de costarle miles y miles de votantes al PSOE (entre los que me encuentro yo) es que NO VA A SERVIR PARA NADA. SERA UN COMPLETO FRACASO.

Los únicos con intenciones mas o menos serias de frenar a esta gente dentro de los que tienen representación son UPyD con una relativa resistencia y de los que no tienen de momento representación (y que yo conozca) El Partido Pirata con una clara resistencia. Si quieres dejar la pelota en algún lado, será mejor que la dejes por ahí.

No contéis con el PSOE, PP, IU, CIU, PNV, CC y NA-BAI porque por desgracia parecen estar todos en el ajo y no solo ofreciendo resistencia 0, sino además de un modo u otro impulsándolo.

Para Eduardo: si que hay partidos que abogan por eliminar la ley sinde, entre ellos IU e ICV (http://www.nacionred.com/default/juan-varela-y-las-enmiendas-a-la-ley-sinde), pero coincido contigo en que esto no es "como no voto al PSOE, voto al PP. Hay más partidos, y todos con sus programas accesibles en internet.

Ejérzamos nuestro derecho al voto de forma responable y actuemos con cabeza (y corazón).

Sugeria UPyD porque muchos han firmado el pacto del software libre, propone desmonopolizar entidades de gestion, cambiar al creative commons, se opone a la ley sinde y al acta, entiende el p2p como una herramienta necesaria de intercambio y por ese camino mas o menos van mas o menos de momento bien encarrilados. Mas que nada por eso lo decia.

Aunque tienes razón en que los verdes también podrian ser una buena elección ya que almenos que yo sepa hay tambien bastantes que suscribieron el pacto del software libre.

En cuanto a lo de ese grafico que salia en la pagina que pusiste lo veo ciertamente relativo, en ese grafico salen representados como "buenos" en un alto numero el PP que intento cargarse directamente la copia privada y el PSOE que nos saca la ley sinde, asi que no me fiaria demasiado de ese dato en concreto...

Pongo a 33 de ejemplo porque es el más descarado. Y digo que es el más descarado por estos motivos:

- Es más largo el enlace de su página que el propio mensaje.

- En el enlace no ha cometido errores, mientras que en ese diminuto mensaje, vaga excusa para meter su anuncio gratis, sí que ha cometido, al menos, dos faltas de ortografía.

- Debo apuntar que los dos puntos anteriores dejan claro que ha dedicado más tiempo a escribir el enlace que a escribir el propio mensaje.

- La web anunciada es claramente comercial.

- Su mensaje sugiere que ni siquiera sabe de qué va el tema. Debe de haber leído sólo lo suficiente como para creerse capaz de escribir seis palabras seguidas con sentido y relacionadas con la entrada. Evidentemente, no ha sido así. ¿Cómo que: "a ver cuando quitan la ley..."?

Pero bueno, a lo que iba.

Queridos spammers, si miráis el código fuente de este blog, veréis que los enlaces llevan un atributo que dice algo así como "nofollow".

Dicho atributo sirve para que los buscadores "pasen por alto" el enlace.

Así que, aparte de conseguir algún clic involuntario de algún despistado que le haya parecido que el comentario era lo suficientemente interesante como para visitar vuestro enlace, el esfuerzo no ha servido de nada.

Os aclaro esto por el bien de todos, incluido el vuestro. A ver si es posible que en el futuro no perdáis vuestro tiempo, ni el de los demás, con esta inútil propaganda.

O son muy ingénuos o son muy idiotas, pero ¿como esperan que miles de personas a los que insultan y persiguen y que van a sufrir una censura y persecución sin precendentes vayan como idiotas a comprar en sus portales?.
El hecho de evitar las descargas ¿aumenta mi poder adquisitivo para que consuma mas?, es que no hay por donde cogerlo es realmente grotesco todo este absurdo circo que han montado los intermediarios para seguir cobrando por la cara.

Yo creo que este tema ya es prehistórico; hace unos añitos la gente no colgaba gratuitamente sus obras musicales o literarias, actualmente existen muchas páginas donde los artistas ponen a disposición del público sus obras porque saben que no hay mejor forma de llegar al público (no diré las páginas por no hacer publicidad pero todos sabemos cuáles son)
¿Mi solución? Consumir productos de artistas que me permiten escuchar sus obras y aprovechar sus conciertos para contribuír a que sigan su carrera y volver a disfrutar de aquellos autores cuyas obras ya tienen los derechos de autor caducados y forman parte del patrimonio artístico mundial. Tienen la batalla perdida desde hace años, que sigan pataleando...

Lo de las sgaes y la industria de contenidos es tan absolutamente flipante que cuesta creer que esto pueda existir en una democracia; es la corrupción más clara y bestial que uno puede llegar a ver, de cómo un entramado privado puede mangonear a tan alto nivel político a los autores como lo hace y cobrar impuestos privados no por sus obras ni de los autores atrapados por contrato, sino por la posibilidad de que alguien pueda leer, ver cine o escuchar música, en general, de cobrar a las instituciones públicas, oficinas, fotógrafos, bares, peluquerías, etc., un impuesto porque sí, porque es su prebenda medieval, con la total connivencia de los poderes públicos. Es tan acojonante lo que ocurre que sería imposible que esto sucediera de no ser porque (aunque nos cueste creerlo) muchísima gente sí se cree la versión sesgada que da la mafia, o al menos le da cierto peso de credibilidad a cómo la industria vende este tema.
La 'batalla argumental' no hay lugar de qué lado se inclina, y por eso los jueces dicen lo que dicen. En la 'batalla política' entra en juego mucho más que los argumentos del tipo de los que un juez puede analizar, no importa tanto quién tiene razón sino "quién parece que tiene razón".
