Cuando leí la noticia (ayer o antes de ayer), me resultó extraña por estos motivos. Si ya hay sentencias firmes anteriores, como podían culpar a alguien que hizo lo mismo? Evidentemente, declarándose culpable. Una mala defensa o un acuerdo que hace sospechar si en el fondo, el acuerdo no es otro.

Sin duda una sentencia-acuerdo a medida de la innombrable, con muchos beneficios para ambas partes.

Dejando de lado la conformidad (que espero que sus motivos tuviera) personalmente no puedo entender que es lo mismo un enlace a contenidos existentes en redes P2P que a servidores de descarga directa, por mucho que el tráfico verdadero no se realice a través del servidor en ninguno de los casos. Una cosa es facilitar el hash de un archivo y que se busque la vida entre los usuarios de redes P2P por decirlo de alguna manera, y otra es decirle "el archivo está aquí físicamente, dale y descárgalo".

Otro tema es que como dices, tal vez intentó evitar que se fueran por otra vía para una reclamación bien gorda (el importe del que se habla al menos es pequeño para el número de obras que dicen que se compartía, cosa rara en reclamaciones de entidades de gestión de este tipo).

En el caso de que efectivamente infopsp no tuviera descargas directas sino sólo enlaces, ¿podemos saber quién ha sido su abogado para jamás, nunca, en la vida pedir su consejo en este u otros temas legales?

Me uno a la pregunta de Javier Candeira (¿de qué me suena este nombre?), dices que la web no contenía "obra alguna sino únicamente los enlaces aportados por sus propios usuarios". La web ahora mismo no está accesible, ni encuentro "copias cacheadas" del estilo de ARCHIVE.ORG, así que no puedo comprobar que eso es como lo cuentas.

En mi opinión, no sólo es relevante si alojaba o no alojaba los archivos en su propia web. También es relevante saber si aún conteniendo únicamente enlaces, los contenidos de dichos enlaces eran facilitados por el administrador de la web. Es decir, si en vez de subir el archivo a mi web lo subo a Megaupload y lo enlazo desde mi web, tal y como yo lo entiendo, legalmente es exactamente lo mismo. En mi web sólo hay enlaces, sí. Pero si esos enlaces llevan a contenidos que yo mismo he subido, estamos en las mismas. ¿Y cómo se sabe que los he subido yo? Bueno, eso será objeto de prueba, pero hay veces que está claro: si en INFOPSP se agregan enlaces a archivos comprimidos en cuyo interior nos encontramos el típico archivo TXT diciendo "por cortesía de INFOPSP", no creo que haga falta hacer muchas piruetas argumentales para imaginar quién los sube.

Por eso, repito, para entender completamente el asunto y saber si se trata de un mal abogado que se baja los pantalones demasiado pronto, o un buen abogado que aconseja no pelear en balde (dicen que más vale un mal acuerdo que un buen pleito), necesitaría saber qué datos se manejan. ¿Dónde se alojaban esos archivos? ¿Quién los subía? ¿Había modo de demostrar quién los subía?

Que cada uno saque sus propias conclusines sobre lo que dicen los medios, sobre lo que dice él, o sobre lo que a cada uno se le ocurra.

Dice que colgará la sentencia. A mí también me gustaría verla para aclarar ideas.

Yo, supongamos que sin ánimo de lucro subo esas películas a Megaupload, y después viene alguien con ánimo de lucro y se aprovecha de mi acción para hacer una web recopilatoria de enlaces.

Yo no sería culpable de nada, ¿pero el webmaster? ¿No está traicionando el espíritu de la ley?

Seamos claros, la mayoría si no todos estos webmasters suben ellos mismos los contenidos, algunos incluso añaden sus URL a las películas... no creo que la policia tuviera mucha complicación en hallar esta conexión.

Los administradores han cerrado la web de forma cautelar, y según se comenta, han contratado a David Bravo.

¿Que infopsp era un web de enlaces? Eso es mentira. No era mas que una página llena de publicidad pornográfica visitada por muchísimos menores (y nada de enseñar culos y tetas, que eso era muy light para la web). De vez en cuando aparecían algunos enlaces a descargas, pero eso era un porcentaje mínimo de lo que había en esa web.

Lo siento, pero soy uno de los que se alegran que ese tipo de webs desaparezcan.

Yo creo que este webmaster no fue muy cauto, subió los archivos a Megaupload el mismo y lo han trincado.

De ahí que haya negociado.

A mi me faltan datos. Desde luego tener acceso a la sentencia es básico para poder determinar en qué se fundamenta y si ese fundamento tiene base o no. Mientras no los tengamos seguiremos elucubrando más o menos.

Por ejemplo, en este post:

se argumentaba que la sentencia tenía que ver directamente con el diferente estatus legal de los videojuegos -artículo 95 y ss. de la LPI- que en este caso se ofrecían crackeados a través de los enlaces. Podría ser, no sé (IANAL) pero insisto en que habría que tener más datos para poder aclarar cómo se ha producido realmente esta 'oportuna' condena.

En vía penal no existe ninguna diferencia entre el software y el resto de obras. En todo caso es exigible ánimo de lucro y comunicación pública (270 CP). Sharemula también enlazaba a software, de ahí que la denunciara Microsoft. Eso nunca fue obstáculo para el sobreseimiento.

En vía civil esa diferencia que apuntas tampoco afecta al que enlaza al programa sino, en todo caso, al que realiza la descarga por no poder ampararse en la copia privada.

Vaya, el artículo está tela de "meneado". Además, FACUA.org lo ha publicado en su portada y soitu.es también.

Falta mucha información sobre el tema. Yo mismo, que creía estar enterado de estos temas, creía que en este caso el delito era por ánimo de lucro, y ahora resulta que no había delito... Y que para que lo hubiera, tendría que cumplirse además la otra condición: "comunicación pública no autorizada", cosa que no ocurría por tratarse de simples enlaces torrent.

En Derecho Penal no hay disposición de las partes sobre el objeto del pleito. O sea, que si hay una Sentencia, OBLIGATORIAMENTE el Juez ha tenido que valorar hechos y calificación jurídica (art. 787.2 LECrim)
Yo también visité INFOPSP y aquello estaba a años luz de ser un servicio de intercambio de archivos libre, privado y gratuito entre usuarios. INFOPSP no era lo que todos defendemos, ni mucho menos.
Esto no quita que, efectivamente, la prensa haya entendido lo que ha querido, o lo que le han dado a entender.

Eso no es una defensa, es una rabieta para justificar lo injustificable. Su juicio era por vía penal, no civil. Y a día de hoy, no se ha denunciado por lo civil a responsables de webs de ese tipo, y mucho menos si habían ganado antes por lo penal.

¿Podrías decirnos como era INFOPSP?, ¿qué la diferenciaba de las webs de intercambio que conocemos?. Así quizás podamos entender el por qué de la sentencia.

Y como información para todos, según informa el propio encausado, aceptó la sentencia condenatoria "con el fin de ajustar la compensación económica por daños y perjuicios que podía derivarse en la vía civil". Es decir que, para evitar la vía civil - no iniciada - acordó una sentencia condenatoria por vía penal.

Reconozco que no entiendo su planteamiento.

"Pleitos tengas y los ganes".
La Justicia parece no estar hecha para personas normales que no tienen ni paciencia ni una billetera infinita para afrontar este tortuoso camino.

ya no se puede acceder a INFOPSP, por razones que son evidentes. Como decía #25 Bye, era una web llena... no, abarrotada, de publicidad de todo tipo. De hecho, en superficie en pantalla, estoy seguro que había más publicidad que enlaces. No es el tipo de web de intercambio de ficheros que yo deseo para la red.
Y yo tambien comparto la opinión de que su acuerdo ha sido inútil. Aun cuando alguien salga absuelto por la vía penal, se le puede exigir la responsabilidad civil. Con que imagínate si alguien ha admitido haber cometido un delito contra la propiedad intelectual.
Que quede claro que la multa impuesta, no es responsabilidad civil, es un tipo de pena. No sirve para indemnizar a los perjudicados.

Sería aconsejable que, en una situación como ésta, sin recursos y sin asesoría especializada, se diera más aire al tema antes y mientras se produce el acuerdo. Estoy segura de que mucha gente podrá y querrá dar una orientación fiable. Es una lástima que esto haya sucedido (aunque comprensible), porque puede sentar precedente (¿es así?).

Pues sí, resulta que en la vía penal se puede delimitar el objeto del juicio. El fiscal determina qué delito cree que hay, y el defensor lo rebate. Si están en el periodo de instrucción y llegan a un acuerdo antes de la apertura del juicio oral, el juez no tiene nada que decir, porque no existe discusión acerca de las calificaciones jurídicas, que, cuando todos los personados califican igual, vinculan al juez a la hora de dictar sentencia. Sólo se puede llegar a conformidad en determinado tipo de delitos, y cuando la pena máxima para el tipo no supera los seis años de prisión, pero poderse se puede.

Por otro lado, sin leer los autos es difícil aconsejar, y sin leer la sentencia es difícil opinar... estaría bien tener acceso a ella.

está claro que al no haber existidio juicio no se pudo aplicar jurisprudencia. Legalmente, tampoco podrá servir de jurisprudencia, pero evidentemente toda la maquinaría de la SGAE y asociados tergiversará esta sentencia pactada para decir que lo jueces se han pronunciado en contra del intercambio de archivos. Espero que en el siguiente jucio (que seguro lo habrá) el abodado defensor tenga a bien recalcarlo en la instrucción.

No obstante y conste que sólo hablo de lo que he leído en diferentes medios imparciales, es decir, de ningún medio con intereses afines a la SGAE, existía una diferencia entre este caso y los anteriores ya que por lo visto algunas de las descargas o accesos a los links requería el envío de un SMS de pago. Entiendo que de ser cierto sí evidencia ánimo de lucro a limitar la compartición a un pago previo.
