Mi vida ha cambiado para siempre. Podría haber sido una de esas personas que el gobierno quiere que sea, pero gracias al conocimiento del que me he nutrido de manera gratuita, de artistas de todo tipo he llegado a desarrollarme como individuo ofreciendo a mis allegados una visión más interesante de la realidad. Viviendo en un pueblo en el que no tenemos ni galerias ni buen cine, ni conciertos he llegado a escuchar blues de comienzos de siglo, cine de Kurosawa, periódicos de américa, exposiciones de todo tipo, y por suspuesto mentes, blogs, ideas. Gracias internet y gracias a todos por compartir.
Ya me extrañaba a mi que no saliera alguna página similar a esta... Chepeau!

En este sentido, la circulacion de “copias privadas” promociona la adquisicion de los soportes originales, puesto que estos ultimos estan producidos con un detalle, unos extras, y una calidad, siempre superior.
6. La “copia privada”, circulando en redes p2p y sitios de hosting, no solo es legal (prestamo de un bien privado), sino un acicate para la compra y consumo de obras culturales en soportes publicados comercialmente.
7. Conclusion: El intercambio de archivos digitales potencia el consumo comercial de cultura, haciendo visibles obras y autores que de otra manera permanecerian ignorados.
No se quién ha hecho esa página pero ha metido la gamba... En "descargas legales" sale "emule24horas", una página en su día muy buena, pero ahora te manda a una que no tiene nada que ver, con una apariencia que imita descaradamente la página oficial del emule y que me da muy mala espina.

Esta web, cuya intención en principio es buena, falla al incluir en el bote a "software y videojuegos" que muy a mi pesar, no entran dentro de la definición de copia privada y por lo tanto, su distribución es ilegal.
( A no ser que sea libre, pero al generalizar se confunde a la gente ... o es que se le intenta engañar deliberadamente ?? Si nos quejamos de la doble moral de la $GA€, del Ministrosaurio de Incultura, y demás ... no caigamos nosotros en lo mismo )
Yo creo que la frase de la campaña debería ir dirigida a la SGAE:

Me ha enganchado desde el principio y lo he leido en la pantalla de un tirón. Como colega (creo que mayor que tú pues acabo de pasar a 52) he disfrutado, me he reído, he releído cuidadosamente la parte técnico-jurídica (deformación, ya sabes) y me ha ayudado a aclarar conceptos (yo soy 'ejerciente' en juzgados y tribunales, no trabajo en despachos de empresas, creo que me entiendes), pero, además, lo que has escrito trasciende el objeto de examen, y eso parece lo más importante.
Estoy dejando el enlace con el mensaje 'lee y difunde' (figuraba, no sé ahora, en la mancheta de 'Mundo Obrero') en los foros que frecuento y rebotando correos a los amigos que creo que están en esta orilla, pero he empezado con mi hija que acaba de iniciar sus estudios de leyes (sin que yo la animara a meterse en ese proceloso mar, por descontado, en fin).
He pinchado hasta encontrar este diario porque sentía la necesidad de darte las gracias más entrañables.

Me dirijo a David o a cualquiera de los ilustrados comentaristas desde el Perú. Tuvimos un interesante debate aquí en la Universidad sobre Propiedad Intelectual, donde se dieron algunos argumentos que espero me ayuden a conceder o rebatir.
1- Cuando uno compra un cd (o un libro, o un dvd) está comprando eso: el cd, pero no está comprando los derechos de autor contenidos en él.
Uno está por tanto legalmente autorizado a hacer lo que quiera con su propiedad (el cd), regalarlo, prestarlo, "compartirlo" y nadie lo persigue por eso. Pero cuando uno hace una copia del cd (duplicación) o lo cuelga en internet (distribución), ya no está compartiendo su propiedad, sino usurpando los derechos de autor de un tercero.
Igual argumento sostienen cuando se trata de la compra de una descarga (sin soporte físico). Uno adquiere el derecho de usarla, no el derecho de duplicarla o distribuirla.
2- En el Perú también existe el derecho a la copia privada (como una excepción a los monopólicos derechos de autor), pero esta debe cumplir al menos dos requisitos: uso personal y ausencia de lucro. El problema radica en el concepto de "uso personal". Por un lado nadie duda que hacer un back up, o pasar el cd a MP3 para el auto ES uso personal, inclusive grabar una selección de canciones para regalar el cd a la novia, etc. En estos casos existe una clara finalidad de beneficio personal y circulación restringida a quienes yo quiero hacer llegar la música. Pero este derecho a la copia privada ¿es el mismo que sustenta el uso impersonal, masivo y sin ninguna restricción de las descargas en redes P2P? ¿Podemos hablar de "uso personal" cuando una vez colgada en el torrent yo ya no puedo evitar que la canción sea descargada por millones que no conozco, ni que, por ejemplo, llegue a mi peor enemigo a quien no deseaba nunca brindar el beneficio de mi derecho a la copia privada? Se ha argumentado que el derecho a la copia privada busca beneficiar al adquiriente no "socializar" la propiedad intelectual.
3-El derecho a la copia privada es un derecho otorgado por el Estado no por los titulares del derecho de autor que, por el contrario, suelen desconocerlo en sus advertencias legales. En este sentido, ¿cómo podrían los Estados a la vez, otorgar un monopolio exclusivo a favor de los titulares para los derechos de duplicación y distribución masiva, e inmediatamente vulnerarlo con el derecho a la distribución y distribución también masiva de copias privadas a través de la internet?
4- Que la propiedad intelectual no es "propiedad" en el sentido clásico del término es algo muy claro para nosotros. Sin ir muy lejos uno describe una relación persona-cosa (derecho real) y el otro una licencia especial de explotación monopólica otorgada por el Estado a un particular (el creador de la obra o sus derechohabientes). La pregunta es, ¿merece esta licencia que llamamos Propiedad Intelectual, la misma protección que goza la propiedad física, sobretodo en cuanto a su duración infinita a limitada? Me explico. El debate actual parece centrarse en cuanto a la existencia misma del derecho de autor y desconocerlo acarrea consecuencias económicas insostenibles. Si es debatible en cambio la duración de tales derechos. Por ejemplo si a los 3 o 4 años, lapso más que suficiente para que autores e inversionistas recuperen y lucren con la obra, caducara el copyright de música, libros y películas, ¿no estaríamos por fin en un camino de solución al problema, equilibrando los intereses de autores y usuarios?
Lamentablemente de la otra parte hubo argumentos mucho más débiles (intelectual y moralmente) basados más en el beneficio evidente de obtener algo gratis por lo que antes se pagaba (de nuestra falta de dinero no puede deducirse el derecho a ver películas sin pagarlas) y de una especie de falso "comunismo", donde todos hablan de compartir pero no cuando se trata de algo que realmente les pertenece.
Lo único rescatable fue alegar la primacía de la realidad como sustento a una posición parecida a la vuestra. Pero lo que se siguió de ello no fue tan claro: De facto los estados han perdido la capacidad de coertio para reprimir la piratería en virtud de las nuevas tecnologías. Aceptado este hecho, ello de por sí me da el derecho de acceder a los contenidos sin pagarlos? Si la tecnología me permitiese con igual impunidad acceder a sus cuentas bancarias, ¿este solo hecho me da de por sí el derecho de disponer de sus ahorros?

Cierto que un músico tiene derecho a ganar dinero por su obra, muy cierto, primero que le page SGAE que para eso nos lo cobran a nosotros, segundo parece ser que hoy en día la forma de ser cantante, músico, etc, etc es sacar discos y video, pues bien yo me crie en la época de los conciertos y muchos músicos se hicieron millonarios así, trabajando, haciendo conciertos, y si, grabando discos, pero sin olvidarse de los conciertos que también da dinero, pero claro eso es mucho trabajo es mejor sacar un disco grabar un concierto y sacarlo muchas veces por televisión y así se promociona el disco, hay que tener poca vergüenza.
Nos cobran entre otras muchas cosas:
• Unidad de almacenamiento: gravado con 12€
• Impresora: de 10€ a 7,95€
• Escáner: 9€
• Teléfono móvil o PDA: 1,5€
• MP3/Mp4/iPods: 3,15€
• Memoria USB 0,30€
• Grabadora CD + DVD 3,40€
• Grabadora CD: 0,60€
• Soporte DVD-RW 0,60€
• Soporte DVD-R 0,44€ (precio de un DVD-R unos 0.48€)
• Soporte CD-RW 0,22€
• Soporte CD-R 0,17€ (el precio del CD-R son unos 0.20€)
hay que tener poca vergüenza.
Yo por ejemplo, no me bajo nunca o casi nunca música, por que escucho poca y con la radio me basta, pero claro ahora que ya pago por ella me voy a descargar a mansalva y a regalársela a mis amigos y familiares, puesto que la he pagado y es mía por propio derecho.
Decir que alguna de la medidas que tomaron en su día contra el pirateo si me parecieron buenas y las use, por ejemplo cuando rebajaron los precios o hacían ofertan de 3 CDs al precio de 1, un CD y DVD por poco dinero, porque yo creo que a casi todos nos gusta tener las cosas originales, lo que no nos gusta es malgastar el dinero, yo en esas ocasiones si he comprado, bastante por cierto.

Mañana Dios dirá.

Microsoft has plans, especially in the realm of games, but I'm not sure I'd want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
